Higier Allen & Lautin, P.C. is pleased to highlight the successful resolution of a recent matter in which Stuart A. Lautin represented a Texas real estate broker and sales agent during an investigation by the Texas Real Estate Commission (TREC).
After a formal complaint alleging multiple violations was filed, TREC elected to open an investigation into the matter. Throughout the process, Stuart represented his clients during interviews conducted by a TREC field investigator, responded to the Commission’s inquiries, and provided supplemental records and evidence addressing the allegations.
As part of his representation, Stuart also worked with the clients and their professional errors and omissions insurance carriers regarding potential coverage for the legal defense. While insurance coverage depends on the terms of each individual policy, many real estate professionals may not realize that legal representation in certain regulatory matters may be covered, or that they may have options regarding the selection of legal counsel.
Following TREC’s review, the complaint was dismissed in its entirety. The broker and sales agent received no disciplinary action, fines, license restrictions, or other penalties.
