Biography
Mr. Montgomery concentrates his practice in the areas of commercial lending, secured transactions, finance, and business transactions. He represents banks and other financial institutions, as well as private investment firms in business matters, including asset acquisitions, loan portfolio acquisitions and related matters. Mr. Montgomery also performs work involving loan restructurings and workouts, loan modifications, and foreclosures.
Experience
- Mr. Montgomery advises clients on all aspects of loan closing and due diligence matters, including title searches, UCC searches, title insurance, organizational and other matters.
- Mr. Montgomery represents financial institutions in all phases of the commercial and residential real property foreclosure process, and the UCC foreclosure process, including pre and post foreclosure issues.
- Mr. Montgomery represents lenders and servicers in connection with loan modifications, extensions, assumptions, workouts, restructurings and related matters.
- Mr. Montgomery advises clients on the acquisition and disposition of commercial and residential properties and related issues.
- Mr. Montgomery represents financial institutions in all phases of commercial and consumer bankruptcies to obtain relief from automatic stay in order to pursue creditor’s rights.
- Mr. Montgomery prepares and negotiates loan documents and conducting due diligence review in connection with loan transactions.
- Mr. Montgomery reviews lender-prepared loan documents.
- Mr. Montgomery represents creditors in commercial collection matters.
