Stuart Lautin authors a regular column, Counsel’s Corner, for the North Texas Commercial Association of REALTOR’S® and Real Estate Professionals website.
The latest column is entitled “Indemnity Equals Guaranty”, and discusses the court’s holding in Wells Fargo Bank, N.A. v. Smuck and White, No. 14-12-00574-CV (Tex. App. – Houston [14th], July 9, 2013). The case centers around claims by a homeowners association against a homeowner for fines in connection with the coverings on the homeowner’s exterior pipes that allegedly were in violation of the homeowners association rules. Ultimately the homeowners prevailed and were awarded attorneys’ fees.
